MINIMUM WAGE INCREASE 2026

 

El 03 de diciembre de 2025 se dio a conocer por parte de autoridades federales el incremento al salario mínimo que se encontrará vigente a partir del 01 de enero de 2026, esto, como resultado de la resolución del Consejo de Representantes de la Comisión Nacional de los Salarios Mínimos (CONASAMI).

On December 3, 2025, the federal authorities announced the increase to the minimum wage that will be in effect as of January 1, 2026, as a result of the resolution issued by the Council of Representatives of the National Minimum Wage Commission (“CONASAMI”, for its acronym in Spanish).

De acuerdo con la información oficial difundida por el gobierno federal y por la propia CONASAMI, el salario mínimo general aumentará un 13%, mientras que en la Zona Libre de la Frontera Norte (ZLFN) el incremento será del 5%, esto, sobre los salarios mínimos que se encontraron vigentes en este año.

According to the official information released by the federal government and CONASAMI itself, the general minimum wage will increase by 13%, while in the Northern Border Free Zone (ZLFN) the increase will be 5%, based on the minimum wages that were in effect this year.

En ese sentido, conviene recordar que el salario mínimo general vigente en el año 2025 corresponde a $278.80 pesos diarios, mientras que el salario mínimo vigente en este mismo año en la ZLFN fue de $419.88 pesos diarios.

In this regard, it is worth recalling that the general minimum wage in effect in 2025 is MXN $278.80 per day, while the minimum wage in the Northern Border Free Zone (ZLFN) for the same year was MXN $419.88 per day.

 

 

NUEVOS MONTOS DE SALARIO MÍNIMO PARA 2026

NEW MINIMUM WAGE AMOUNTS FOR 2026

A partir del 01 de enero de 2026, los salarios mínimos diarios serán los siguientes:

As of January 1, 2026, the daily minimum wages will be as follows:

a.      Salario mínimo general:

a.      General minimum wage:

-        315.04 pesos diarios, o su equivalente mensual a razón de $9,451.20 pesos.

-        MXN $315.04 per day, or its monthly equivalent of MXN $9,451.20.

-        Incremento aproximado: 13%.

-        Approximate increase: 13%.

b.      Salario mínimo en la Zona Libre de la Frontera Norte (ZLFN):

b.      Minimum wage in the Northern Border Free Zone (ZLFN):

-        440.87 pesos diarios, o su equivalente mensual a razón de $13,226.10 pesos.

-        MXN $440.87 per day, or its monthly equivalent of MXN $13,226.10.

-        Incremento aproximado: 5%.

-        Approximate increase: 5%.

Es importante considerar que la CONASAMI suele ajustar también los salarios mínimos profesionales, por lo que será importante revisar las tablas específicas que en su momento se emitan y publiquen para el año 2026.

It is important to note that CONASAMI also tends to adjust professional minimum wages, so it will be necessary to review the specific tables that will be issued and published for 2026 in due course.

Estos ajustes al salario mínimo forman parte de la política de recuperación gradual del poder adquisitivo del salario mínimo, pero al mismo tiempo generan impactos inmediatos en nómina, estructura salarial, contratos individuales y colectivos, así como en presupuestos operativos y administrativos para el año 2026.

These adjustments to the minimum wage are part of the policy of gradually restoring the purchasing power of the minimum wage, but at the same time they generate immediate impacts on payroll, salary structures, individual and collective employment agreements, as well as on operating and administrative budgets for 2026.

También debe considerarse que este incremento impacta en forma directa la forma de pago y de cálculo de varios conceptos y prestaciones legales y laborales, como lo es, por ejemplo, la prima de antigüedad.

It should also be taken into account that this increase directly affects the method of payment and calculation of various legal and employment-related items and benefits, such as, for example, the seniority premium.

 

 

ÁMBITO DE APLICACIÓN

SCOPE OF APPLICATION

El salario mínimo general aplica como piso para todas las personas trabajadoras que no estén sujetas a un salario mínimo profesional específico.

The general minimum wage applies as a floor for all workers who are not subject to a specific professional minimum wage.

En la ZLFN continuarán aplicando los salarios mínimos diferenciados exclusivamente para los municipios y demarcaciones que la propia CONASAMI señale en la resolución correspondiente.

In the ZLFN, differentiated minimum wages will continue to apply exclusively to the municipalities and districts identified by CONASAMI in the relevant resolution.

El incremento debe respetarse proporcionalmente cuando existan jornadas reducidas (por ejemplo, media jornada), de manera que la remuneración nunca sea inferior al mínimo aplicable en función del tiempo trabajado.

The increase must be observed proportionally in the case of reduced working hours (for example, part-time work), so that remuneration is never lower than the applicable minimum based on the time worked.

El salario mínimo es un estándar inderogable y constituye un derecho y una prestación irrenunciable: no puede ser disminuido mediante contrato individual, convenio o contrato colectivo.

The minimum wage is a non-derogable standard and constitutes a right and a benefit that cannot be waived: it cannot be reduced by means of an individual employment agreement, settlement agreement, or collective bargaining agreement.

 

 

¿QUÉ DEBEN HACER LAS EMPRESAS A PARTIR DEL 01 DE ENERO DE 2026?

WHAT SHOULD EMPLOYERS DO AS OF JANUARY 1, 2026?

1.      Verificar que ninguna persona trabajadora quede por debajo del nuevo salario mínimo en su zona.

1.      Verify that no worker is paid below the new minimum wage applicable in their zone.

2.      Ajustar tabuladores y contratos (individuales y, en su caso, colectivos) que utilicen el salario mínimo como referencia.

2.      Adjust pay scales and employment agreements (individual and, where applicable, collective bargaining agreements) that use the minimum wage as a reference.

3.      Actualizar parámetros en nómina y sistemas internos (CFDI, cálculo de horas extra, etc.). Así también deben efectuarse las actualizaciones correspondientes ante los sistemas de las autoridades fiscales, hacendarias y de seguridad social.

3.      Update payroll parameters and internal systems (CFDI, calculation of overtime, etc.). Likewise, the corresponding updates must be made in the systems of the tax, treasury, and social security authorities.

4.      Revisar el impacto presupuestal y, en su caso, adecuar políticas de compensación variable y prestaciones ligadas al salario.
